Gert Jan Geertjes defends preliminary advice Nederlandse Vereniging voor Wetgeving

At the annual conference of the Nederlandse Vereniging voor Wetgeving (the Dutch association for legislation) that was held in the Auditorium of the Ministries of Internal Affairs and Kingdom Relations and Justice and Security in The Hague on Thursday 6 October, Gert Jan Geertjens defended the draft of his preliminary advice titled 'Democratische legitimatie, zorgvuldigheid en transparantie: een reflectie op de drie waarborgen van de formele wetgevingsprocedure’ (Democratic legitimacy, due care and transparency: A reflection on the three safeguards of formal legislative procedure).

In his preliminary advice, he concludes that the formal legislative procedure, or at least its constitutional implementation, has remained mostly unchanged and has rarely been up for discussion over a period of well over 150 years. However, the latter appears to be changing, due to developments such as digitalisation, the fragmentation of the political landscape, and problems identified in regard to the execution of legislation, for instance, against the background of the recent childcare benefits scandal.
