About

Ruben van Uden (1992) studied Law (LLB) and Civil law (LLM, cum laude) at Leiden Law School. After finishing his LLM degree in Leiden he studied Comparative and European Private Law at the University of Edinburgh (postgraduate LLM, with distinction).

Since 1 September 2017 Ruben is connected to the Institute for Private Law, department of Civil Law, as PhD Fellow and since April 2024 as assistant professor. His research interests are primarily within the law of property.

PhD Research

Title PhD research: Ranking of claims in insolvency. Justifications and explanations

Ruben’s PhD research is about the rules on ranking of claims in insolvency. When a company becomes insolvent (the value of) the assets of the company is mostly insufficient to pay all the claims of the creditors in full. This activates the rules on ranking, in which (according to Dutch law) secured creditors and the tax office have strong positions. The PhD research consists of two perspectives. At first, the research is about the scientific justifications for awarding a preferential status to a claim (i.e. economic efficiency). Secondly, the current Dutch rules on ranking are being subjected to a historical-explanatory analysis, in order to explain why the these rules are as they are. Both perspectives then are being compared, followed by a evaluation of the role of the legislator in this area of law. The research concludes with recommendations to improve the law on ranking of claims.
