AI, Healthcare, and the Law Panel at CPDP 2020
On 24 January 2020, eLaw attended the Annual Conference on Privacy and Data Protection (CPDP) in Brussels, Belgium. The overarching theme of the 13th edition was "Data Protection and Artificial Intelligence," and our colleague Dr. E. Fosch-Villaronga organised a panel on AI, Healthcare, and the Law within the scope of his Marie Sklodowska-Curie grant on Healthcare Robots and AI.
The panel addressed the legal and ethical questions on the integration of artificial intelligence (AI) technologies in healthcare. Typical applications of such systems include personalised diagnosis, early disease detection, hospitalisation risk prediction, and pattern discovery, and the overall goal is to help deliver a safer, more efficient, and personalised care. However, these technologies process vast amounts of data that can learn from experience, and self-improve their performance over time, challenging the applicability of traditional regulations that were not designed for progressive and adaptive AI. Since automated processing of data can evaluate, analyse, and predict health-related outcomes, not only data protection but also the safety of the individual might be compromised.
In this respect, the panel explored the suitability of the existing legal framework for the increasing development and use of AI in healthcare, giving concrete examples of care applications, identifying specific problems, and discussing with the audience potential solutions. In the end, Dr E. Fosch-Villaronga stressed, we have to 'make kindness the norm' if we want to enjoy the potential benefits of these technologies and, at the same time, protect user's rights.
