Music venue TivoliVredenburg in Utrecht has decided to ban camera glasses following an incident last month. Bart Schermer, Professor of Law and Digital Technologies, spoke to BNR Nieuwsradio about the legal grounds for such a ban.
TivoliVredenburg has included a ban on camera glasses in its house rules. The venue’s management decided to take this step in response to an incident last month at a festival in Rotterdam. There, a man was caught filming women in the toilets with camera glasses. Last weekend, for the first time, a security guard denied a visitor entry to the venue as he refused to take off his camera glasses.
According to Professor Schermer, in principle you are allowed to film while walking around in public spaces wearing these glasses. ‘But the question is: what are you using them for, what are you filming, and to what extent does the person being filmed realise what is happening?’ For example, filming in a toilet area or changing room is explicitly forbidden says the professor. But recording a group of people during a concert is not a crime, as long as the images are not of a sexual nature or involve victims of an accident.
