New publication by Christa Tobler and co-author Joel Günthardt on the mutual recognition of professional qualifications
According to the recent case law of the Court of Justice of the European Union, primary law in the area of recognition of professional qualifications is also applicable if a situation falls within the scope of directive law, but its requirements for recognition are not met. The article examines the implications of this case law for the relationship between Switzerland and the EU. At the same time, it serves to clarify the earlier Jusletter article 'Zur Diplomanerkennung im Freizügigkeitsabkommen Schweiz - EU' (on diploma recognition in the Agreement on the Free Movement of Persons between Switzerland and the EU) of 14 June 2021 by Joel Günthardt.
