Martijn van den Brink participates in the EU Law Mountain Seminar in the Czech Republic

From 10-13 June, Martijn van den Brink participated in the EU Law Mountain Seminar in the Czech Republic. This event is a regular gathering of scholars interested in public law in Europe founded by Marco Dani and Jan Komárek in 2017. These are closed events where selected researchers discuss their ongoing work.

Martijn presented his paper ‘Constitutionalism without Principle: Article 2 TEU and the Heidelberg School of European Constitutionalism’. The paper critically examines the intellectual tradition behind a certain approach to EU constitutional law (called the Heidelberg School of European Constitutionalism) that is very present in the debate on EU values. The paper criticises the School’s constitutional methodology and argues that the proposals of its members are increasingly becoming undemocratic and unconstitutional.

The paper was discussed by Joana Mendes. Other participants were Mark Dawson, Sabine Mair, Marco Dani, Jan Komárek, Ondrej Kadlec, Signe Rehling Larsen, Filip Horák, Paul-Linden Retek, Maciej Krogel, and Irene Pollini.
