Islam, State Law, and Culture: Extra-Judicial Marital Practice among Indonesian Muslims in Bengkulu (Bengkulen)

Supervisors: Prof. dr. Léon Buskens and Dr. Adriaan Bedner

This research looks at how the Indonesian state intervenes itself into the administration of Muslim familial affairs by accommodating a number of elements such as Islamic law itself, special demands of women and culture. Although attempts have been made by the state to govern familial issues by requiring them be settled at state institutions, extra-judicial practices remain prevalent among Indonesian Muslims. This phenomena leads to further inquiry on how Muslims in the area of study, Mukomuko-Bengkulu, construct different values—including Islamic law, state law, and culture—and present themselves through extra-judicial discourse and practice so as to provide assessment toward the institutionalization of judicial authority among Muslims society. In sum, the study, first, will provide an explanation of how access to justice is gained and implemented by people and Islamic judges respectively, and, second, put the encounter of these values within Indonesian legal discourse and practice into light.
