Christa Tobler speaker on Brexit and dispute settlement
On 8 November 2017, The Law Societies Joint Brussels Office of the UK organised a seminar on the subject of ‘Brexit: Where & How to Enforce: Building Blocks for a New Dispute Settlement System’. The seminar was held in the building of the European Parliament in Brussels.
Christa Tobler, Professor of European Law at the Universities of Basel (Switzerland) and Leiden, spoke on ‘The “Swiss model” with respect to enforcement’. The presentation and discussion related to both disputes involving at least one private party and disputes between the parties to the agreement.
The “Swiss model” relates to the institutional framework of the existing agreements between the EU and Switzerland and also to the ongoing negotiations on a revised framework for a number of existing as well as new market access agreements. These negotiations run parallel with the negotiations between the EU and the EU and the AMS states (Andorra, Monaco and San Marino) on the institutional framework of an encompassing internal market association of these countries.
