Aviation sector appeals against reduction in flights at Schiphol
Several airlines, including KLM, are continuing to fight on at the Dutch Supreme Court against a reduction in flights at Schiphol. The airlines want the Supreme Court to overturn the Court of Appeal’s decision.
'The sector is in with a chance at the Supreme Court. The ruling ignores the fact that European law takes precedence over national law. What’s more, the Minister is using a regulation that is not intended to interfere extensively with capacity at Schiphol’, says Pablo Mendes de Leon, professor emeritus air and space law in Dutch newspaper the Telegraaf (€).
By mid-September, it must be clear how large the reduction in flights needs to be in order to know what can be facilitated at the airport by 1 April 2024.
Mendes de Leon foresees a long road ahead. 'Proceedings at the Supreme Court are certainly not going to be quick, since they may also refer questions to the European Court in Luxembourg about applicability of the prescribed EU procedure.’
