In December 2020, after heated negotiations, the EU institutions adopted the Rule of Law mechanism, which provides for a system of annual review of institutions linked to the rule of law in the member states: justice systems, anti-corruption framework, media pluralism and freedom, etc. Importantly, meeting the benchmarks of the report is supposed to have consequences for access to EU structural funds. The member states reached the agreement in principle on the mechanism, leaving to the Commission to work out the details of its enforcement. Nearly a year later, however, the Commission has not yet moved to withhold funds from any of the member states, despite mounting infringements, and the European Parliament is preparing a lawsuit against the Commission for failing to implement the Mechanism.

MEP Sophie in ‘t Veld is a member of Renew Europe fraction in the European Parliament and one of the most vocal proponents of the mechanism. In this European Seminar she will speak about the reasons for the creation of the mechanism, the enforcement failures, and the responsibilities of different EU institutions for upholding the rule of law in the Union.
