Winter Lecture ‘Hazards in Transnational Legal Transactions

As legal norms are transplanted across jurisdictions, it is tempting but hazardous to proceed on the premise that they operate similarly. This is true in transplantations across different legal traditions, but it is equally true for superficially similar norms within the same legal tradition. This, which may be termed the ecosystem risk, counsels a deep appreciation of the nature of the norms; it also counsels acute sensitivity to the conflicting norms, and the values that drive the resolution of the tensions. The transnational adoption of standard contract templates thus requires attention to measures for risk mitigation. Through case studies, the lecture examines the ecosystem risk and the lessons presented to lawyers engaging in transnational legal work. 

Alexander Loke JSD, LLM (Columbia), LLB (Hons) (NUS) is Professor at City University of Hong Kong School of Law and Director of the Hong Kong Commercial & Maritime Law Centre. Professor Loke researches and publishes on contract law, corporate and securities law, and international finance and capital markets. Professor Loke was Deputy Director of the Centre for Banking & Finance Law at NUS Law, and was responsible for creating its researcher programme. He was also the founding chief editor of the Asian Journal of Comparative Law, which was accorded "A" in Australian Research Council ranking of world journals.

The Winter Lecture is about one hour incl. Q & A, followed by drinks to meet staff, students and other professionals.
