Exploring migrants’ lived experiences of the legal systems

Whilst ‘the law’ (international norms, state immigration law and policies) regulates the movement of people, the ‘black letter law’ does not operate in a vacuum. It is important therefore to ask what are the effects of the law on the governed mobile populations, how does the law work ‘in action’ in the social world, what are the processes of meaning making that accompany it, and with what consequences? This lecture will provide an overview of the different, empirically informed theoretical approaches developed by the socio-legal scholars to capture the nuanced relationships between migrants and the legal systems of the host countries. In providing the empirical context the lecturer will draw on her research of migration law ‘in action’ in comparative context across Europe and Russia.

Agnieszka Kubal is a Research Fellow at the Centre for Socio-Legal Studies at University of Oxford; she joined the Centre from International Migration Institute (ODID). Her research examines the relationship between the immigration law and migrants. This investigation is sociological, conceptualising migrants as agents responding to the new socio-legal environment. Agnieszka is currently working on her second monograph ‘Immigration and Refugee Laws in Russia: comparative and socio-legal perspectives’ (contracted by CUP) questioning whether migrants’ experiences in Russia and in Europe are as much in contrast as many observers would tend to assume.

Agnieszka teaches socio-legal approaches to migration (MSc in Migration Studies). In 2012 she received a Teaching Excellence Award in recognition of her outstanding contribution towards teaching on the MSc in Migration Studies. She is a member of SLSA and Migration Law network. In 2016 she was a Visiting Fellow at Davis Center for Russian and Eurasian Studies, Harvard University.
